Please read these Terms of Service ("Terms") carefully before booking services or using the website located at kartandcraving.com (the "Site"), owned and operated by Kart and Craving LLC ("Kart and Craving," "we," "us," or "our"). By booking an event, placing an order, or otherwise using the Site, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree, please do not use the Site or book our services.
1. Our Services
Kart and Craving provides grazing table, charcuterie board, and related catering and event styling services ("Services") for private events, corporate functions, and other gatherings within our designated service area of [service area / cities / mile radius]. Menu offerings, pricing, and package details are described on the Site or provided directly to you in a quote or booking confirmation and may change without notice until a booking is confirmed in writing.
2. Bookings and Confirmation
A booking is not confirmed until: (a) you have submitted a completed booking request through the Site or by direct communication with us, and (b) we have received your non-refundable deposit as described in Section 3. We reserve the right to decline or limit any booking, including due to date availability, event location, minimum order requirements, or capacity.
Event date, guest count, menu selections, and delivery/setup details should be finalized no later than 14 days before your event. Guest count changes made after this date may be accommodated at our discretion and may result in additional charges. Final guest counts confirmed by this date are the minimum number we will invoice for, even if actual attendance is lower.
3. Payment, Deposits, and Cancellations
Deposit. A non-refundable deposit of 20% of the total order is required to reserve your date. This deposit will be applied toward your final invoice.
Balance Due. The remaining balance is due no later than 14 days prior to your event date. We accept payment via credit/debit card, Zelle/Apple Pay and invoice link.. Bookings with an outstanding balance past the due date may be canceled without further notice.
Cancellations by Client. If you cancel your booking, your deposit is forfeited and non-refundable under any circumstances, as it reserves your date and turns away other business. If cancellation occurs after the balance has been paid, any remaining balance beyond the deposit will be refunded only if cancellation occurs at least 30 days before the event; cancellations made within 14 days of the event are non-refundable in full.
Cancellations or Changes by Kart and Craving. In the rare event we must cancel due to illness, emergency, or circumstances beyond our control, we will notify you as soon as possible and provide a full refund of all amounts paid, or, where possible, help coordinate a suitable alternative vendor. Our liability in such cases is limited to the amount you have paid us.
Rescheduling. We will make reasonable efforts to accommodate a single date change if requested at least [X] days in advance, subject to availability. Rescheduling requests made after this window will be treated as a cancellation subject to the policy above.
4. Rental Equipment (Carts, Boards, Tables, and Dishware)
Certain packages include the use of reusable equipment such as grazing carts, boards, risers, tables, linens, and dishware ("Rental Items") that remain the property of Kart and Craving at all times.
Care and Use. Rental Items must be used only for their intended purpose and kept in the condition provided, normal wear excepted.
Return Window. Unless we perform scheduled pickup as part of your package, Rental Items must be returned, in substantially the same condition as delivered, within 72 hours of your event's end. Pickup logistics and location will be confirmed at booking.
Late Returns. A late fee of $25 per day may apply to Rental Items not returned within the agreed window.
Damage, Loss, or Excessive Cleaning. You are responsible for any Rental Items that are lost, stolen, or damaged beyond normal wear while in your possession, and for any cleaning beyond normal use. Replacement or repair costs, and any applicable cleaning fee, will be charged to the card or payment method on file or invoiced separately.
5. Delivery, Setup, and Access
Delivery and setup times are scheduled in advance and are approximate; we are not responsible for delays caused by traffic, weather, venue access restrictions, or other conditions outside our reasonable control. You are responsible for ensuring reasonable access to the event location (including parking, elevators, stairs, and venue permissions) at the scheduled setup time. Additional fees may apply for difficult access, excessive setup distance, or delays caused by the venue or client that extend our staff's time on site.
6. Food Safety and Allergen Disclaimer
Our grazing tables and charcuterie offerings may contain, or be prepared in facilities that also process, common allergens including but not limited to nuts, dairy, gluten, soy, and shellfish. While we are happy to accommodate specific dietary requests communicated to us in advance, we cannot guarantee any item is completely free of allergens or cross-contact, and we are not liable for allergic reactions or dietary sensitivities experienced by you or your guests.
Perishable food should not be left unrefrigerated for more than two (4) hours (or one hour in outdoor temperatures above 90°F/32°C), consistent with standard food safety guidance. We are not responsible for illness or spoilage resulting from food left out beyond recommended timeframes, improper storage after our service window ends, or consumption after the event has concluded.
7. Photography and Marketing
We may photograph or video our setups at your event for our own portfolio, website, and social media use. If you prefer that images from your event not be used publicly, please notify us in writing prior to your event date and we will honor that request.
8. Limitation of Liability
To the fullest extent permitted by law, Kart and Craving's total liability arising out of or related to any booking or these Terms shall not exceed the total amount paid by you for the applicable Services. We are not liable for any indirect, incidental, special, or consequential damages, including loss of enjoyment of an event, arising from our Services or use of the Site.
9. Website Use
You agree to use the Site only for lawful purposes and not to misuse, interfere with, or attempt unauthorized access to the Site or its underlying systems. All content on the Site, including text, images, logos, and menu designs, is owned by or licensed to Kart and Craving and may not be copied or used without our prior written permission.
10. Privacy
Information you provide when booking or contacting us (such as your name, email, phone number, and event details) is used solely to fulfill your booking and communicate with you. For more detail on how we collect, use, and protect your information, please see our Privacy Policy.
11. Force Majeure
We are not liable for any failure or delay in performing our Services due to causes beyond our reasonable control, including but not limited to severe weather, natural disaster, government action, road closures, or public health emergencies. In such cases, we will work with you in good faith on rescheduling or, where appropriate, a partial refund.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our practices or for legal or operational reasons. The version posted on the Site at the time of your booking will govern that booking. We encourage you to review these Terms periodically.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of Kansas], without regard to its conflict-of-law principles. Any dispute arising out of these Terms or our Services will first be attempted to be resolved informally by contacting us directly.
